Commissioners extend burn ban until Aug. 22

The Falls County Commissioners Court met on Aug. 8 at the County Courthouse in Marlin. Judge Jay Elliott presided. Commissioners present were Milton Albright (Pct. 1), F.A. Green (Pct. 2), and Jason Willberg (Pct. 3) and Commissioner Nita Wuebker (Pct. 4).

Commissioner Green motioned to keep the burn ban in effect until Aug. 22. Seconded by Commissioner Albright, the motion carried. 

Commissioner Albright moved to adopt several individual resolutions including an order approving Road Use Agreement with Copperhead Solar, LLC, Interlocal Agreement for Assessment and Collection of Taxes for the City of Rosebud and the approval of the Office of the State Attorney General OAG) amendments to the Statewide Automated Victim Notification Service grant program; motion carried. 

In other matters, Commissioners approved compensatory time for Sheriff Deputy Keaton T. Smith and approved the Tri-County SUD Road bore for CR 251 utility line to customer water. Commissioner Wuebker moved to accept the Falls County Emergency Service District #2 audit; seconded by Commissioner Willberg, motion carried. Commissioners also approved to pay $7217.86 for indigent health. Commissioner Green moved to approve the payment of all bills, budget amendments, and payroll; Seconded by Commissioner Albright, motion carried. Prior to the meeting adjournment, Commissioner Albright moved to approve the minutes of the previous meeting. Motion carried.

County Judge Jay Elliott presented a detailed overview of the 2022-23 budget including anticipated income and expenses, the Falls County Detention Center; departmental line items; all funds, including general and Farm-to-Market Lateral Road Fund, upcoming year’s Appraisal District Budget, fees for processing payroll and other relevant fees concerning the budget.

In business from the July 25 meeting, following executive session, Commissioner Green moved that the firm of Haley & Olson, P.C. be hired to sue Young Livestock Ranch, LLC on behalf of Falls County to protect and establish the existence and rights of the public in both a county road and a public park areas on the west side of the river, and to require the removal of a fence and enjoin interference with the public’s use of these areas by Young Livestock Ranch, LLC directly or indirectly. Commissioner Albright seconded the motion. Motion carried.

The 2022-23 Commissioners Court Budget meetings are scheduled every Monday and Thursday beginning Aug. 8 and ending Aug. 29. The next Special Agenda meeting is Thursday, Aug. 11, at 9 a.m. Public hearing on proposed tax rate will be Sept. 12 and the Formal Adoption of the Budget and Formal Adoption of Tax Rate/Commissioners Court is Sept. 26.
