SECTION 1 – DESCRIPTION OF PROJECT AND SCOPE
1.1 – Contract Characteristics.
The Rosebud-Lott Independent School District (“RLISD”) intends to award a Design-Build contract to the highest-ranked respondent that is capable of designing, constructing, and managing RLISD’s 2024 Bond Project (“Project”). Selection of the Design-Build Team (“DBT”) is by means of a qualifications-based evaluation process. The ability of the successful DBT to deliver the Project on time, on budget, within the criteria and constraints identified in this document, and pursuant to the requirements of Texas Local Government Code 2269, so as to furnish the “best value” to RLISD, will determine the ranking for, and eventual selection of, the successful DBT for the Project.
All responses to this Request for Qualifications (“RFQ”) that satisfy the stated criteria contained within this document shall be evaluated by RLISD. The various respondents will then be ranked from highest to lowest and RLISD will commence negotiations with the highest-ranked DBT.
1.2 – Challenges.
The successful DBT must demonstrate their ability to address the following challenges:
• Managing the fixed budget to achieve acceptable levels of quality, while providing all program spaces as directed by RLISD for the completed Project.
• Scheduling construction activities and site traffic so as not to create hazardous conditions for RLISD students, staff, and/or local residents.
• Designing and delivering the prescribed facility upgrades included in the Project, in such a manner so as to ensure an optimal learning environment for RLISD students and teachers.
• Managing and monitoring the job progress throughout the design and construction phases to meet RLISD timelines.
1.3 – Partnership.
The degree of success of the Project will depend largely upon the nature of the relationship between RLISD and the successful DBT – working together as an integrated team with common goals of improving quality, improving productivity, achieving cost savings, and achieving other economies and efficiencies across the full spectrum of performance. RLISD will provide the successful DBT with flexibility to determine specific work methods that satisfy the performance-based requirements of the District. RLISD expects the successful DBT to take customer preferences into consideration, participate with RLISD in continuous improvement activities (such as optimizing the phasing of the Project), and proactively address any risks and/or challenges to the Project’s success. RLISD will work with the successful DBT to implement processes, as are appropriate, that maximize efficiency and transparency.
All questions and correspondence in conjunction with this RFQ are to be made in writing and should be directed to the RLISD contact identified below. Contact with any other RLISD personnel at any point in the evaluation process is strictly prohibited and could result in rejection of any related submission:

1.4 – Scope of Work.
• Pre-construction planning including assistance in the preparation of a schedule, preliminary cost estimate, and value engineering measures.
•
Prepare site, architectural, structural, mechanical, plumbing, and/or electrical design plans as applicable for the Project based upon RLISD’s guidance.
•
Site Design: demolition and clearing plans, grading and drainage plans, sedimentation and erosion control plans, layout and staking plans, elevations and sections, construction details, lighting and signage, landscape and planting plans and details.
• Building Design: building plan configuration and elevation elements including exterior building skin materials and colors, foundation, structural and roof systems, building fenestration and openings, overall dimensions, materials testing requirements.

Mechanical/Electrical/Plumbing Design: systems, equipment calculations, energy and performance modeling, systems review, coordination and integration to include all utilities and controls.
• Development and refinement of cost estimates and project schedules.
• Collaborating with RLISD staff to best determine the facility layout and functionality to most effectively achieve the programming needs of the school.
• Construction administration and observation including daily site construction management, safety inspections, daily contractor coordination meetings, and weekly progress meetings with RLISD.

Project closeout, establishment of warranties, guarantees, and owner’s manuals.
1.5 – Project Milestones.
• Issue RFQ: November 25, 2024
• Advertise RFQ: from November 25, 2024 -to- December 09, 2024
• Deadline for written questions and clarifications on RFQ: December 09, 2024
• Deadline for submission of RFQ responses: December 11, 2024
• District staff selects the highest-ranked DBT: December 18, 2024
• Notify selected DBT and commence contract negotiations: December 19, 2024
• School Board award of contract: January 15, 2025
• Notice to Proceed: January 16, 2025
• Project Completion: To be Finalized After DBT is Selected

SECTION 2 – REQUEST FOR QUALIFICATIONS (RFQ)
2.1 – Pre-Submission Inquiries. Submit written inquiries, questions, or comments by email to the individual listed in Section 1.3 of this document. All requests for information or clarification must be submitted by RLISD prior to the date listed in Section 1.5 of this document or they will not be addressed. Unless the question deals with issues of a proprietary nature, written responses to all questions or comments will be answered by RLISD addendum. It is each respondent’s sole responsibility to ensure that they acquire any/all addenda issued, or questions answered, by RLISD.
2.2 – Date, Time, and Place of Submission. In order to be considered for award, RFQ responses must be submitted in accordance with the requirements stated in Section 2.3 of this document, and must be received by RLISD no later than 2:00 PM CST on December 11, 2024. RLISD will date and time stamp each submission and any late submission received will remain unopened and will receive no further consideration. All submitted materials will become the property of RLISD and will not be returned.
2.3 – Submission Format. RFQ responses shall conform with the instructions in this section. Any deviation may result in the exclusion from further consideration (in the sole discretion of RLISD). Responses shall be limited to ten (10) pages in length and each firm shall submit three (3) hardcopies of their response to RLISD. Respondent shall also submit one (1) PDF copy to the RLISD contact person listed in Section 1.3.
2.4 – Confidential Information. The State of Texas Open Records Act may result in requests from outside entities for copies of proposals submitted to RLISD. If a DBT’s response contains information that it believes should be withheld from such requestors under the Open Records Act (on the grounds that they contain trade secrets), it is recommended that the DBT mark its submission in the following manner:

The following notice should be placed on the title page: “Some parts of this document are considered by the submitter to be privileged and/or confidential trade secrets, not subject to mandatory disclosure under the State of Texas Open Records Act. Material considered privileged or confidential on such grounds is contained on page(s) _______”.
•
Under no circumstances is a submission to be marked, nor will it be considered, confidential or privileged in its entirety, regardless of what submitter might include.
2.5 – Submission Requirements. The following information shall be submitted as part of this RFQ:

Section E: Insurance
2.5.1 – Relevant Project Summaries. Submit the following information for three (3) similar projects previously performed by your Firm for other K-12 school districts in the State of Texas:
• Name of Texas K-12 school district client
• Phone number and email address for client’s main Point of Contact
• Scope of work implemented
• Contract value of the work implemented
• Disclosure of any safety violations received
2.5.2 – Management Approach.
A. Project Team: Provide a summary of your organizational structure, key team members that will be involved in the Project (inclusive of employees and any 3rd party firms that will be involved), specific roles, responsibilities, and team members’ qualifications, along with anything else that RLISD should consider. List the specific strengths of your Project Team, as well as any perceived shortfalls.
B. Capacity to Perform: Describe how you intend to deliver the Project successfully and how you will address any performance shortfalls and/or problems that occur during implementation.
C. Knowledge of the Project: Provide a summary of your understanding of the Project and specific examples that demonstrate your knowledge of RLISD’s existing conditions and needed upgrades.
2.5.3 – Litigation. Submit a list of any previous project(s) that involved litigation, along with the reason for the litigation and how that litigation was resolved. If not applicable, please certify as such.
2.5.4 – Bonding Capacity. Provide a letter of bondability from your Surety and/or Bonding Company stating total capacity to handle this Project, along with an indication of past performance elsewhere.
2.5.5 – Insurance. Submit a current Certificate of Insurance with type(s) of coverage and ensure that all minimum coverage amounts comply with State of Texas statutory requirements. Coverage must be from established insurance carriers with AM Best Rating of at least B++ (Good) and the successful DBT must keep coverage in place for at least three (3) years after the date of substantial completion of the Project.
SECTION 3 – OVERVIEW OF SELECTION PROCESS AND SCORING CRITERIA
3.1 – Selection Process. The successful DBT will be chosen using a qualifications-based selection process during the RFQ phase, followed by a negotiation process (pursuant to Texas Local Government Code 2269) for the final award and approval. The qualifications-based scoring criteria is included in Section 3.4 below.
3.2 – Negotiations. RLISD will commence negotiations with the highest-ranked DBT for a contract to design and construct the Project, for a fair and reasonable fee, pursuant to Section 2269 of the Texas Local Government Code. If RLISD cannot negotiate a contract within thirty (30) days of selection, RLISD reserves the right to terminate those negotiations and commence negotiations with the second-ranked DBT.
3.3 – Notice of Owner’s Discretion. RLISD reserves the right to reject any submission, including the right to reject all submissions and to restart this RFQ process. RLISD also reserves the right to waive any defect and/or irregularity in any of the submissions received, so long as said defect or irregularity does not render the submission nonresponsive or in violation of Section 2269 of the Texas Local Government Code.
3.4 - Scoring Criteria. All responses that are submitted correctly will be evaluated pursuant to the weighting schedule listed below. Total scores will be calculated and all responses will be ranked by RLISD.
